Lucknow, 29 October. Now after being selected for a government job, youth will not have to wait for appointment till the character verification report comes. The state government has issued a new integrated policy of character and antecedent verification to make the appointment process simple and time-bound. Under this, even while the police verification process is ongoing, selected candidates will be given appointment letters with conditions. After getting the correct verification report, the appointment will be confirmed. Police and concerned officers will have to provide the verification report within 30 days. This will remove unnecessary delay in the appointment process as well as provide relief to the candidates from repeatedly making rounds of police and administrative offices.

The government of Chief Minister Yogi Adityanath has prescribed integrated guidelines in place of the government orders issued so far regarding the process of character verification before the first appointment of selected candidates in various departments. In the government order issued by Principal Secretary M. Devaraj, it has been clarified that the process of issuing appointment letter will not be stopped only because the verification report is pending. The appointing authority will issue the appointment letter after obtaining the prescribed verification form and self-declaration from the candidate. However, from the point of view of security, appointment to sensitive posts will be given only after detailed verification is completed. In such special cases, prior approval of the Chief Minister will have to be taken under the prescribed procedure.

Police will not call, verification will be done from records
In the new policy, special care has been taken of the convenience of the candidates. In normal circumstances, for character verification, the police or local intelligence unit will not go to the candidate’s house for inquiry. He will also not be called to appear in person. There will also be no need to ask for additional documents. The police will give the report after investigation on the basis of available records. In special circumstances, on the request of the appointing authority, the District Magistrate will be able to get the inquiry done on the spot.

For verification, the Director General of Police (Intelligence) and District Magistrates will have to provide the report within 30 days of receiving the reference. If the report is not received within the stipulated period, the appointing authority will send the matter to the Home Department. The Home Department will ensure necessary action to make the report available.

Appointment will not be stopped only due to case being registered
The government has also clarified the rules related to criminal cases. The candidate will not automatically become ineligible only due to FIR being registered, investigation pending or charge sheet being filed. His eligibility will be decided on the basis of the nature of the crime and the status of the case in the court. In some prescribed categories of serious crimes, ineligibility will apply on framing of charges or conviction by the court, while in other categories conviction will be necessary.

Provisions have also been made for relief in cases of final acquittal by the court, disposal of the case through compromise as per law and in cases of some minor crimes. However, the candidate will have to give correct information about the cases registered against him. There is a provision for cancellation of appointment and legal action on deliberately concealing facts or making false declaration.

Even on adverse report, opportunity will be given to present side
Even if the report of the police or local intelligence unit is adverse against any candidate, he will be given an opportunity to present his side. The District Magistrate will hear the concerned candidate before sending his report to the appointing authority. This hearing can also be done online.

Character verification will not be done again for employees already working in government service. If required, information can be taken from their previous department. In respect of candidates who have stayed outside Uttar Pradesh for one year or more in the last five years, information will also be taken from the police of the concerned state.

The new policy will be applicable to appointments made through direct recruitment in corporations, councils, educational institutions, autonomous bodies, undertakings and local bodies along with government departments. Pending cases will also be disposed of as per the new guidelines.
